Photographer Agreement
This agreement sets the ownership, permission, quality, licensing, payout, and conduct rules for photographers using OlaClip.
Last updated September 22, 2026
1. Agreement and eligibility
This Photographer Agreement supplements the Terms of Service and applies when you create a photographer account, create a session, or upload media. You must have legal capacity to contract and must provide accurate identity, contact, tax, and payout information when those features become available.
2. Ownership and authority
You keep copyright in your media. You promise that you created each upload or hold all rights needed to upload, display, market, license, sell, and deliver it through OlaClip.
You are responsible for obtaining permissions, releases, licenses, or other legal grounds required for identifiable people, private locations, protected works, music, trademarks, minors, or other third-party material. Capturing someone in a public surf setting does not automatically grant every possible commercial right.
3. License to OlaClip
While media is listed, you grant OlaClip a non-exclusive, worldwide license to host, store, copy, process, transcode, resize, crop, watermark, display, promote, and deliver that media as reasonably necessary to operate and market the marketplace.
You may remove media prospectively, subject to active orders, disputes, legal holds, backup cycles, and takedown review. The license continues as needed to honor completed customer licenses, provide replacement downloads, maintain transaction evidence, and comply with law.
4. Listings and quality
- Describe the session, capture time, media type, quality, and price accurately.
- Upload usable originals that correspond to the protected previews and are free of undisclosed technical defects.
- Keep an independent backup of every original and do not use OlaClip as the sole archive.
- Do not publish unlawful, dangerous, deceptive, infringing, privacy-invasive, or exploitative media.
5. Prices, fees, payouts, and taxes
The current beta does not collect customer payment or make payouts. You may arrange payment directly with a customer. OlaClip does not charge a platform fee on these beta requests and is not the merchant, escrow provider, or payment processor for a direct transaction.
You must mark a request paid only after you have actually received the agreed funds. You are responsible for confirming the amount and currency, providing required receipts or tax documents, handling direct-payment refunds and disputes, and meeting your own registration, invoicing, tax, consumer, and business obligations.
Before integrated payments launch, OlaClip will disclose the platform fee, payment-processing deductions, payout timing and method, minimums, refunds, chargebacks, currency conversion, and any tax treatment that OlaClip administers.
6. Orders, licenses, and customer support
When a paid order is completed, you authorize OlaClip to grant the customer the license stated in the Terms or at checkout. You will reasonably help resolve wrong-file, corrupt-file, ownership, quality, refund, and chargeback claims.
Removing your account or media does not revoke a customer license already granted after payment. OlaClip may deduct or recover refunds, chargebacks, taxes, or amounts caused by your material breach, as described in final payout terms and permitted by law.
7. Safety, privacy, and respectful conduct
Do not create media unlawfully, trespass, interfere with rescue operations, endanger surfers or the public, or use OlaClip for stalking or harassment. Take particular care with children and sensitive situations. Comply with beach, drone, protected-area, and local filming rules that apply to you.
8. Review and takedowns
OlaClip may review, limit, unpublish, or remove media when it receives a rights or safety report, reasonably suspects a violation, or must comply with law. You must respond with requested proof of ownership or permission. The Copyright and Takedown Policy explains the reporting and response process.
9. Independent relationship and responsibility
Photographers use OlaClip independently. This Agreement does not create employment, partnership, agency, exclusivity, or authority to bind OlaClip. You control how and whether you capture media, subject to law and these rules.
You are responsible for claims, losses, or costs caused by your media or a material breach of your promises, to the extent permitted by law. OlaClip remains responsible for its own obligations and conduct; nothing here removes rights that cannot legally be waived.
10. Ending the agreement
You may stop listing new media at any time. OlaClip may suspend or terminate photographer access for serious or repeated violations, fraud, security risk, or legal necessity. Ownership, completed customer licenses, payment and dispute duties, and provisions intended to survive will continue after termination.
