Commercial terms
Terms of Service
These terms explain the rules for the OlaClip beta, the future purchase flow, and the personal-use license customers receive for purchased surf media.

1. About these terms
These Terms govern access to OlaClip by photographers, customers, and visitors. By creating an account, uploading media, submitting a checkout request, or otherwise using OlaClip, you agree to these Terms and the policies linked from them.
OlaClip is currently offered as a public beta. OlaClip does not collect, process, hold, or distribute customer payments during this beta. A photographer may arrange payment directly with a customer and manually unlock a private delivery after confirming receipt. Before OlaClip processes payments or charges platform fees, this section will identify the service operator by legal name, tax details, and legal domicile. Until then, questions and notices may be sent to support@olaclip.com.
2. Eligibility and accounts
You must have legal capacity to enter into these Terms. If you are under the legal age to contract, a parent or guardian must use the service and accept these Terms for you.
You must provide accurate account information, protect your credentials, and promptly notify OlaClip of suspected unauthorized access. You are responsible for activity carried out through your account unless applicable law provides otherwise.
3. Sessions, media, and previews
A session groups media captured by a photographer at a particular place and time. The photographer controls the session details, selected media, publication status, and listed prices, subject to OlaClip rules.
Customer previews may be lower resolution, cropped, watermarked, or otherwise protected. Preview access is only for evaluating a possible purchase. You may not remove a watermark, scrape, copy, publish, redistribute, or commercially use a preview.
4. Selection requests and direct payment
During the beta, a selection request records the selected media, displayed price, and order reference. It does not require the customer to create an account or provide an email address or phone number to OlaClip. A customer may optionally provide an email address for a release notification. OlaClip does not charge a card or verify payment. The photographer and customer arrange payment through their existing communication channel or in person.
Customers should confirm the photographer identity, amount, currency, payment method, refund terms, and any required receipt before paying. Direct payment is between the photographer and customer; keep independent proof of payment. A status shown in OlaClip is the photographer’s confirmation and is not a bank or payment-provider record.
After submitting a selection, the customer receives a private order link. Anyone with that link may be able to view the selection and, after the photographer unlocks it, download the purchased originals. The customer is responsible for keeping the link private.
When paid checkout is enabled, OlaClip will show the seller or service-provider identity, media selected, total price, currency, applicable fees and taxes, payment method, delivery method, and any legally permitted withdrawal limitation before the customer confirms payment. A written electronic confirmation will follow the transaction.
5. Customer media license
After successful payment and subject to any license displayed at checkout, the customer receives a non-exclusive, worldwide, perpetual license to download, store, edit, and share the purchased media for personal, non-commercial use, including personal social-media posts.
Unless applicable law or a separate written agreement provides otherwise, the customer does not acquire copyright ownership. Without a separate commercial license, the customer may not resell, sublicense, commercially advertise with, make merchandise from, provide as stock media, or redistribute the original file for others to use.
Subject to rights arising under applicable law or a separate agreement, the photographer retains ownership of the media and all rights not expressly licensed. OlaClip may offer expanded commercial licenses in the future, with the scope and price shown before purchase.
6. Photographer terms
Photographers who create sessions or upload media also agree to the Photographer Agreement. Among other things, they promise that they own or are authorized to commercialize the media and have obtained permissions required by law.
7. Acceptable use
- Do not upload or distribute unlawful, infringing, deceptive, abusive, exploitative, or privacy-invasive material.
- Do not attempt to bypass preview protections, access another user's private data, probe the service, introduce malicious code, or disrupt OlaClip.
- Do not impersonate another person, misstate ownership, manipulate an order, or use OlaClip for fraud or unauthorized surveillance.
- Do not use automated collection or extraction tools without OlaClip's written permission.
8. Consumer rights, delivery, and refunds
Nothing in these Terms excludes rights that cannot lawfully be waived, including rights under Chilean consumer law when it applies. The Refund and Download Policy explains delivery problems, duplicate charges, defective files, withdrawal rights, and how to request help.
9. Copyright and other rights
OlaClip respects copyright, image rights, privacy, and other third-party rights. Reports may be submitted under the Copyright and Takedown Policy. OlaClip may restrict or remove media while a report is reviewed and may suspend repeat or serious violations.
10. Suspension and termination
You may stop using OlaClip at any time. OlaClip may restrict or terminate access when reasonably necessary to protect users or the service, investigate misconduct, comply with law, or address a material breach. Where appropriate, OlaClip will provide notice and an opportunity to respond.
Terms that by their nature should survive termination remain effective, including ownership, completed customer licenses, payment obligations, dispute records, and responsibility for prior violations.
11. Beta availability and liability
The beta may change, pause, lose test data, or contain errors. Keep independent copies of original media and do not rely on OlaClip as your only archive. OlaClip does not promise uninterrupted availability during the beta.
To the maximum extent permitted by law, OlaClip is not liable for indirect or consequential losses arising from beta use. This limitation does not apply where liability cannot legally be limited, including mandatory consumer protections or liability caused by willful misconduct or gross negligence where applicable.
12. Changes and governing law
Material changes will be posted with a new effective date and, when appropriate, presented for renewed acceptance. Chilean law governs these Terms, without limiting mandatory protections available to a consumer in another jurisdiction. Courts and authorities with jurisdiction under applicable law may hear disputes.
A Spanish commercial version, final operator disclosures, payment-provider terms, platform fees, and tax information will be completed before OlaClip activates integrated payments or charges platform fees.
